Legislative Updates: Compliance Checklist for 2012
Learn what not to overlook for this New Year.
- Update versions of all required posters.
As of January 1, 2012 the required California and federal employment notices from 2011 are out of compliance and must be replaced with 2012 posters. If you are a HR Support customer, you received the required Federal and State posters for 2012. If you would like posters, contact us to sign up for HR Support services ($180 per year) and receive your posters within the month, access to templates, legislative updates, and three hours of HR support specific to your organization. - Prepare a wage notice in compliance with AB 469
The Wage Theft Protection Act of 2011 requires that employers provide specific employment information at the time of hiring. California Department of Industrial Relations issued a template to use and FAQ. Notice to Employee Template Assembly Bill No. 469 FAQ
- Review pregnancy related policies.
If necessary revise your pregnancy leave policies to comply with SB 299 which requires employers with five or more employees to continue to maintain and pay for health coverage under a group health plan for an eligible female employee who takes Pregnancy Disability Leave (PDL) up to a maximum of four months in a twelve month period. - Review company policy for conducting background checks
Review your policy to confirm that you don't obtain consumer credit reports for purposes not permitted under A.B.22 which places restrictions on certain types of employers and jobs. See Assembly Bill No. 22
- Updates for San Francisco Employees
San Francisco employers must update employee rates to meet the new minimum wage of $10.24 per hour and comply with the new HCSO regulations. Visit our blog Managing the HCSO with an HRA in 2012
- Review plan for health care
reporting on W-2s Employers issuing more than 250 W-2s for 2011 must comply with a provision of the Affordable Care Act that requires reporting the cost of employer sponsored group health plans on the W-2s for 2012. See IRS Notice 2011-28 or September 2011 Newsletter for a summary

Additional FUTA Tax Payment Due Tax ALERT Due to loans made from the federal government to the following states: AK, CA, CT, FL, GA, IL, IN, KY, MI, MN, MO, NV, NJ, NY, NC, OH, PA, RI, VA, and WI, an additional payment will be due for Federal Unemployment Tax (FUTA) for 4th Quarter 2011. If your company paid wages in 2011 in one of these states, please see the letter in your 2011 Year End tax package. It will detail the additional taxes. The 2011 Year End Tax Packages will be sent on Tuesday, January 17, 2012.
If your company is utilizing our Tax Service, the amount will be debited from your company bank account on January 20, 2012. Your debit amount will be included in your yearend package. Contact your payroll specialist if you would like to know the amount before receiving your year end package.
If your company does not utilize our Tax Service, then the additional amount will be included in the FUTA tax check that we produce for you. If you have any questions regarding this additional assessment, please contact your payroll specialist.

COBRA FAQ: Can I receive COBRA benefits while on FMLA leave? The Family and Medical Leave Act, effective August 5, 1993, requires an employer to maintain coverage under any group health plan for an employee on FMLA leave under the same conditions coverage would have been provided if the employee had continued working. Coverage provided under FMLA is not COBRA coverage, and FMLA leave is not a qualifying event under COBRA. A COBRA qualifying event may occur, however, when an employer's obligation to maintain health benefits under FMLA ceases, such as when an employee notifies an employer of his or her intent not to return to work. Note, that even if FMLA regulations do not apply to your organization, Senate Bill 299 applies to California employers with more than five employees. Direct deposits do not post on weekends or bank holidays. If your company's regularly scheduled check date requires a change to accommodate the holidays, payroll data must be submitted two business days (and by 1pm) prior to the intended check date to provide tax or direct deposit services.
