EEO-1 Form Filing Deadline Extended by the EEOC

The Equal Employment Opportunity Commission (EEOC) has extended the EEO-1 federal filing deadline from July 19, 2021, to August 23, 2021.

Who must file?

Qualifying employers include:

  • Employers with at least 100 employees
  • Federal contractors with at least 50 employees and a contract of $50,000 or more with the federal                                                                                           government

The EEOC uses the information from these EEO-1 reports to analyze employment patterns, according to the agency.

The EEOC originally planned to open collections of data in 2020 for 2019 numbers. Ultimately, they opted to pause the process due to the onset of COVID-19. They then opened the EEO-1 filing portal in late April of 2021.

Since then, the EEOC has received a high number of company support requests for reporting mergers and acquisitions. They have also received many support requests for user registration assistance. Pausing the reporting process in 2020 has created a backlog of these requests.

However, they still encourage that all eligible employers file their respective reports as soon as possible.

What information needs to be submitted?

Under current federal law, only Component 1 data for 2019 & 2020 is required for the August 2021 deadline.
EEO-1 Data

From 2017-2018, the EEOC additionally collected Component 2 data. This included additional information like employee’s hours worked and pay specifics. A legal dispute recently challenged the EEOC’s requirements for additional data, and now Component 2 is no longer a federal requirement. However, it still a requirement in some states.

For instance,  California recently passed a law under which component 2 data is required to be submitted to the California Department of Fair Employment and Housing (DFEH).

The reports that you submit need to meet certain standards and requirements by the EEOC. Therefore, we recommend that you speak with a trusted partner or professional before you submit anything.
